Altough the case itself does not directly refer to the issues of fundamental rights within the European Union, we would like to share with you the opinion of Advocate General on the case which does and will cause a lot of controvercies, even after the judgement of CJEU: C-434/15 Asociación Profesional Elite Taxi v Uber Systems Spain, SL. The case regards whether and to what degree the company Uber renders services of information society.

It is the Advocate General’s opinion that “Uber does not benefit from the principle of freedom of service guaranteed in the EU law for the information society services.” You may find a press release of CJEU under the following link: https://curia.europa.eu/jcms/upload/docs/application/pdf/2017-05/cp170050pl.pdf The full text of the opinion can be found under this link: http://curia.europa.eu/juris/documents.jsf?num=C-434/15.
